HIRE AGREEMENT TERMS AND CONDITIONS
 
I, the Customer, hereby hire the items, from FormalWear Express, for the date of use, on the terms and conditions as set out below.
 
 
 
GENERAL
1.                     This Agreement is the entire Agreement between the Customer and FormalWear Express.
a.                     Amendments to this agreement can only be made in writing and signed by both parties hereto.
2.                     In no case does the hire agreement cover a period greater than 6 days.
3.                     All prices are subject to change without notice.
4.                     Promotional or discount vouchers may only be redeemed if notified at the time of booking a fitting consultation and discounts are applied to full hire rates only.
a.                     Only one voucher per event maybe redeemed and they may not be used in conjunction with any other offer or promotion.
b.                     Offers and promotions can be withdrawn at anytime without notice to any party.
 
Limited Liability
5.                     FormalWear Express's liability, in any event, is limited to the value of the cost of hire paid by the Customer.
 
HIRED ARTICLES
6.                     Goods are hired to the Customer on the understanding that they shall be returned in an undamaged condition and the Customer will be responsible for, and indemnify FormalWear Express against, any loss or damage to the goods whilst on hire.
Incidental Damage Waiver
7.                     An Incidental Damage Waiver fee, in the amount of $12.00, will be added to all Hire agreements, unless declined by the Customer, this provides cover to the following items:
a.                     Splitting of seams;
b.                     Damage to zippers; and
c.                     Loss or damage to buttons.
8.                     The Incidental Damage Waiver DOES NOT COVER loss, theft or malicious damage including, but not limited to:
a.                     Damage of garments due to spillage;
b.                     Cigarette burns to garments; and
c.                     Accidental tears when suit comes into contact with sharp objects 
d.                     Suit covers, hat boxes, shoe trees and bags are loaned at no extra cost but are subject to a surcharge of $22.00 each if not returned or returned damaged.
 
Security deposit
9.                     Each order requires a security deposit in the amount of $550.00. The security deposit is payable by credit card only, as provided. The security deposit is held and is not processed except in the event of non-return or damage.
 
Customer's responsibility to deliver measurements for outstanding parties
10.                  The Customer will ensure that FormalWear Express receives accurate size information for all party members not measured by our consultants at least 3 weeks before the function date. A late handling fee of $55.00 is charged for each party that does not provide the required information in this time frame.
 
CANCELLING AN ORDER
11.                  Orders that are cancelled WITHIN 14 DAYS of delivery date will be charged at the full hire rate without any refund whatsoever. Orders cancelled prior to this date are subject to a $100 cancellation fee per suit, which will be deducted from deposit paid and balance of deposit will be refunded within seven days.
 
FINAL PAYMENT BEFORE DELIVERY
12.                  Any outstanding balance must be paid by the Customer at least TEN (10) DAYS prior to delivery. Garments will not be delivery without payment in full.
 
DELIVERY OF HIRED ARTICLES
13.                  Garments will not be left at unattended premises. In the event the garments have to be redelivered because the delivery address was unattended at the agreed delivery time then a redelivery fee in the amount of $55 will be charged.
 
FINAL CUSTOMER CHECK
Customer's responsibility to check delivered articles
14.                  The Customer warrants that they will arrange for all hired items on their order to be checked for correctness of size, colour and style WITHIN 24 HOURS FOLLOWING DELIVERY TO ENSURE THAT ALL HIRED ITEMS ARE CORRECT, COMPLETE AND IN GOOD CONDITION. FormalWear Express will not be liable for any loss suffered by a Customer who does not comply with this clause, nor will FormalWear Express be liable for any loss of profit or any indirect or consequential loss suffered.
 
Last minute alterations (Second Fitting)
15.                  All alterations to garments, originally measured by our consultants, notified to FormalWear Express WITHIN 24 HOURS following delivery shall be conducted free of charge.
All required alterations notified to FormalWear Express more than 24 hours following delivery shall incur an exchange fee of $55.00 per callout.
 
COLLECTING HIRED ARTICLES
16.                  All hired items MUST be available for collection on the next Business day following the event or at the date, time and location agreed, prior to delivery. The Customer grants to FormalWear Express a three hour window, either side, of the agreed time.
Overdue collections
17.                  Hired items not made available at the agreed time or location shall incur an additional charge in the amount of $55.00 per suit per day.
a.                    Collection fees for hired items not available for pick up shall be charged at the rate of $55.00.
 
DAMAGED ARTICLES
18.                  The security deposit shall be forfeit, in part or in full at the absolute discretion of FormalWear Express, by the Customer if, in the sole opinion of FormalWear Express, the hired items are returned damaged, except where damage is covered under the Incidental Damage Waiver, or if the garments are not returned due to loss or theft.
Damage caused to a garment deprives FormalWear Express from using that garment in the normal course of their hire business. Further, garments may take up to 4 months to be replaced. Subsequently, when calculating the fiscal amount of damage to a garment, FormalWear Express shall consider both the replacement cost of the garment and the loss of revenue incurred to the business.
In the event that the security deposit is drawn upon, in part or in full, by FormalWear Express the Customer shall be notified and invoiced in writing.
The Customer agrees that it is at the discretion of FormalWear Express whether the damage is solely to be deemed accidental or not.
